{"id":164585,"date":"2024-01-05T20:48:28","date_gmt":"2024-01-05T19:48:28","guid":{"rendered":"https:\/\/radiostargjilan.com\/web\/?p=164585"},"modified":"2024-01-05T20:48:28","modified_gmt":"2024-01-05T19:48:28","slug":"statusi-juridik-i-statutit-te-asociacionit-te-komunave-me-shumice-serbe-ne-kosove","status":"publish","type":"post","link":"https:\/\/radiostargjilan.com\/web\/statusi-juridik-i-statutit-te-asociacionit-te-komunave-me-shumice-serbe-ne-kosove\/","title":{"rendered":"Statusi juridik i statutit t\u00eb Asociacionit t\u00eb komunave me shumic\u00eb serbe n\u00eb Kosov\u00eb"},"content":{"rendered":"<p>Shkruan: Dr. Flamur Hyseni<\/p>\n<p>Pas paralajm\u00ebrimeve t\u00eb kryeministrit t\u00eb Shqip\u00ebris\u00eb, Edi Rama, \u00ebsht\u00eb publikuar nj\u00eb draftstatut i AKS-s\u00eb p\u00ebrmes ish-politikanit dhe ish-zyrtarit t\u00eb lart\u00eb t\u00eb AKI-s\u00eb (Agjencia e Kosov\u00ebs p\u00ebr Inteligjenc\u00eb).<\/p>\n<p>Pas disa dit\u00ebve u konfirmua se draftin e kan\u00eb lexuar disa politikan\u00eb t\u00eb opozit\u00ebs, p\u00ebrderisa \u201cdraftstatuti\u201d zyrtar po mbahet larg publikut, sepse faktori nd\u00ebrkomb\u00ebtar paska k\u00ebrkuar k\u00ebshtu.<\/p>\n<p>Vazhdon mungesa e transparenc\u00ebs lidhur me \u00e7\u00ebshtjen e themelimit t\u00eb AKS-s\u00eb, edhe pas debatit parlamentar dhe debatit n\u00eb media.<\/p>\n<p>E r\u00ebnd\u00ebsishme \u00ebsht\u00eb se drafti q\u00eb \u00ebsht\u00eb b\u00ebr\u00eb publik prej qarqeve jokompetente, i cili mundet me qen\u00eb real, q\u00eb mund t\u2019i k\u00ebrkohet Qeveris\u00eb ta b\u00ebj\u00eb zyrtar t\u00eb nj\u00ebjtin duke e miratuar, ka shum\u00eb konfuzione juridike dhe i konkurron rregullimit shtet\u00ebror t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs.<\/p>\n<p>Jan\u00eb disa aspekte juridike lidhur me disa nene t\u00eb draftstatutit t\u00eb AKS-s\u00eb, q\u00eb bien ndesh me rendin juridik \u2013 kushtetues t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, rregullimin shtet\u00ebror dhe form\u00ebn e qeverisjes, si n\u00eb vijim:<\/p>\n<p>Baza juridike e draftstatutit<\/p>\n<p>Te baza juridike duhet t\u00eb k\u00ebrkohen sqarime se p\u00ebrse draftstatuti i AKS-s\u00eb e ka p\u00ebr baz\u00eb Marr\u00ebveshjen e 2013, kur kjo marr\u00ebveshje nuk \u00ebsht\u00eb ratifikuar nga Kuvendi i Republik\u00ebs s\u00eb Serbis\u00eb?<br \/>\n\u00c7far\u00eb relevant\u00eb juridike ka kjo marr\u00ebveshje e paratifikuar nga Serbia?<br \/>\nPse i k\u00ebrkohet Kosov\u00ebs t\u00eb negocioj\u00eb p\u00ebr draftstatutin e AKS-s\u00eb, q\u00eb \u00ebsht\u00eb pun\u00eb e brendshme e Kosov\u00ebs?<\/p>\n<p>T\u00eb sqarohet, pse duhet me qen\u00eb baz\u00eb juridike e statutit t\u00eb AKS-s\u00eb, Rezoluta 1244\/99 e K\u00ebshillit t\u00eb Sigurimit t\u00eb OKB-s\u00eb, kur statusi juridik dhe politik i Kosov\u00ebs \u00ebsht\u00eb i zgjidhur?<\/p>\n<p>Pas hyrjes n\u00eb fuqi t\u00eb Kushtetut\u00ebs, 15\/06\/2008, realiteti juridik, lidhur me shtet\u00ebsin\u00eb e Kosov\u00ebs \u00ebsht\u00eb i pranuar juridikisht n\u00eb aspekt nd\u00ebrkomb\u00ebtar.<br \/>\n\u00c7far\u00eb r\u00ebnd\u00ebsie kan\u00eb aktet nd\u00ebrkomb\u00ebtare dhe disa ligje t\u00eb p\u00ebrmendura si baz\u00eb juridike, kur nj\u00ebkoh\u00ebsisht p\u00ebrmendet edhe Kushtetuta, kur dihet se Kosova me Kushtetut\u00ebn e 2008 i ka p\u00ebrfshir\u00eb t\u00eb gjitha k\u00ebrkesat e \u201cnd\u00ebrkomb\u00ebtar\u00ebve\u201d, lidhur me \u00e7\u00ebshtjen e pakicave, konkretisht pakic\u00ebs serbe? Pse duhet t\u00eb rirregullohet di\u00e7ka q\u00eb \u00ebsht\u00eb e rregulluar tash e mbi 15 vjet?<\/p>\n<p>Neni 2 [sfondi dhe objektivat]<\/p>\n<p>T\u00eb k\u00ebrkohen sqarime pse duhet t\u00eb rishkruhen nene t\u00eb cilat jan\u00eb n\u00eb Kushtetut\u00eb dhe ligjet p\u00ebrkat\u00ebse prej dat\u00ebs 15 qershor 2008. T\u00eb gjitha k\u00ebto q\u00eb jan\u00eb shkruar n\u00eb nenin 2, jan\u00eb n\u00eb kapitullin e tret\u00eb t\u00eb Kushtetut\u00ebs.<\/p>\n<p>Neni 6 [ndryshimet n\u00eb statut]<\/p>\n<p>Ndryshimet n\u00eb statut nuk mund t\u00eb b\u00ebhen n\u00eb k\u00ebt\u00eb form\u00eb, ku pas ndryshimeve t\u00eb k\u00ebrkohet vler\u00ebsim nga Gjykata Kushtetuese, sepse statuti nuk \u00ebsht\u00eb kushtetut\u00eb. Subjektet e p\u00ebrmendura n\u00eb nenin 5 nuk jan\u00eb pal\u00eb e autorizuar p\u00ebr t\u00eb ngritur \u00e7\u00ebshtje n\u00eb Gjykat\u00ebn Kushtetuese. Kjo nuk \u00ebsht\u00eb e p\u00ebrcaktuar me Kushtetut\u00eb, neni 113, paragraf\u00ebt: 1 \u2013 10.<\/p>\n<p>AKS nuk \u00ebsht\u00eb subjekt shtet\u00ebror, q\u00eb organet e tij t\u00eb ken\u00eb t\u00eb drejt\u00eb t\u00eb jen\u00eb pal\u00eb e autorizuar p\u00ebr t\u00eb ngritur \u00e7\u00ebshtje n\u00eb Gjykat\u00ebn Kushtetuese. Pse tentohet t\u00eb b\u00ebhet kjo?<\/p>\n<p>IV. Neni 7 [\u00e7\u00ebshtjet administrative]<\/p>\n<p>Pse duhet t\u00eb jet\u00eb Mitrovica veriore qend\u00ebr administrative e Asociacionit?<br \/>\nAsociacioni duhet ta ket\u00eb qendr\u00ebn\/selin\u00eb e saj n\u00eb kryeqytetin e Republik\u00ebs s\u00eb Kosov\u00ebs, n\u00eb Prishtin\u00eb.<\/p>\n<p>Pse duhet t\u00eb p\u00ebrmendet n\u00eb draftstatut Mitrovica e Veriut? \u00c7ka ka m\u00eb shum\u00eb Mitrovica e Veriut sesa Gra\u00e7anica, Sht\u00ebrpca, Ranilluku, Parteshi?<\/p>\n<p>V. Neni 10 [t\u00eb drejtat e komuniteteve]<\/p>\n<p>T\u00eb k\u00ebrkohen sqarime pse duhet t\u00eb rishkruhen nene t\u00eb cilat jan\u00eb n\u00eb Kushtetut\u00eb dhe ligjet p\u00ebrkat\u00ebse prej dat\u00ebs 15 qershor 2008. T\u00eb gjitha k\u00ebto q\u00eb jan\u00eb shkruar n\u00eb nenin 10 t\u00eb draftstatutit jan\u00eb n\u00eb kapitullin e tret\u00eb t\u00eb Kushtetut\u00ebs.<\/p>\n<p>VI. Neni 13 [objektivat dhe kompetencat e p\u00ebrgjithshme]<\/p>\n<p>Pse duhet AKS-ja t\u00eb krijoj\u00eb akte m\u00eb t\u00eb ul\u00ebta sesa Kushtetuta dhe ligji p\u00ebr t\u2019i promovuar t\u00eb drejtat e garantuara t\u00eb komunitetit serb, t\u00eb cilat t\u00eb drejta jan\u00eb t\u00eb garantuara me Kushtetut\u00eb dhe legjislacion n\u00eb nivelin m\u00eb t\u00eb lart\u00eb dhe asnj\u00ebher\u00eb nuk ka pasur probleme t\u00eb tilla, q\u00eb prej 12 qershor 1999.<\/p>\n<p>N\u00eb paragrafin 6, t\u00eb nenit 13 p\u00ebrcaktohet se: \u201cAsociacioni do t\u00eb mb\u00ebshtes\u00eb ushtrimin, si\u00e7 p\u00ebrcaktohet n\u00eb k\u00ebt\u00eb Statut, t\u00eb p\u00ebrgjegj\u00ebsive komunale n\u00eb fushat e kompetencave t\u00eb an\u00ebtar\u00ebve t\u00eb saj dhe t\u00eb zgjeruara, me p\u00ebrjashtim t\u00eb atyre t\u00eb listuar n\u00eb nenin 40.2 t\u00eb Ligjit p\u00ebr Vet\u00ebqeverisjen Lokale\u201d.<\/p>\n<p>T\u00eb sqarohet kjo: \u201ct\u00eb p\u00ebrgjegj\u00ebsive komunale n\u00eb fushat e kompetencave t\u00eb an\u00ebtar\u00ebve t\u00eb saj dhe t\u00eb zgjeruara\u201d. \u00c7ka do t\u00eb thot\u00eb kjo?<\/p>\n<p>Asnj\u00ebher\u00eb deri m\u00eb tani nuk ka ndodhur ndonj\u00eb penges\u00eb, p\u00ebrve\u00e7 nd\u00ebrhyrjeve nga Serbia, q\u00eb komunat me shumic\u00eb serbe t\u00eb mos ken\u00eb pasur mund\u00ebsi t\u00eb ushtrimit t\u00eb kompetencave t\u00eb tyre. Pse t\u00eb rirregullohet kjo?<\/p>\n<p>VII. Neni 14 [Menaxhimi i institucioneve arsimore dhe sh\u00ebndet\u00ebsore t\u00eb themeluara dhe financuara nga Serbia]<\/p>\n<p>Neni 14 \u00ebsht\u00eb i t\u00ebri n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn e Kosov\u00ebs. Krijon sistem arsimor dhe sh\u00ebndet\u00ebsor paralel me autoritetin e shtetit serb n\u00eb Kosov\u00eb.<\/p>\n<p>Ky nen duhet t\u00eb sqarohet dhe rishikohet me shum\u00eb kujdes kurdo q\u00eb do t\u00eb shqyrtohet drafti i statutit si draft final.<\/p>\n<p>N\u00ebse ky nen lejohet t\u00eb jet\u00eb n\u00eb statut si i till\u00eb, at\u00ebher\u00eb do t\u00eb kemi \u201clegalizim\u201d t\u00eb sistemit paralel arsimor dhe sh\u00ebndet\u00ebsor t\u00eb shtetit serb n\u00eb Kosov\u00eb.<\/p>\n<p>VIII. Neni 15 [p\u00ebrgjegj\u00ebsit\u00eb shtes\u00eb n\u00eb lidhje me arsimin]<\/p>\n<p>Rrjedhimisht edhe neni 15 \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn.<\/p>\n<p>Nd\u00ebrsa, te paragrafi d), p\u00ebrcaktohet se: \u201cOfron mb\u00ebshtetje ligjore, shkencore, financiare dhe sekretare p\u00ebr an\u00ebtar\u00ebt e saj n\u00eb zbatimin e kompetencave t\u00eb tyre n\u00eb fush\u00ebn e arsimit, p\u00ebrfshir\u00eb arsimin e lart\u00eb, si\u00e7 parashikohet me ligj\u201d.<\/p>\n<p>Sipas \u201cPakos s\u00eb Ahtisaarit\u201d, e cila \u00ebsht\u00eb e p\u00ebrfshir\u00eb n\u00eb Kushtetut\u00ebn e Republik\u00ebs s\u00eb Kosov\u00ebs, e vetmja komun\u00eb q\u00eb ka kompetenca n\u00eb fush\u00ebn e arsimit t\u00eb lart\u00eb \u00ebsht\u00eb Komuna e Mitrovic\u00ebs s\u00eb veriut.<\/p>\n<p>Pse AKS-ja t\u00eb marr\u00eb k\u00ebto autorizime dhe t\u00eb mb\u00ebshtes\u00eb n\u00eb ushtrimin e k\u00ebtyre kompetencave? Ky \u00ebsht\u00eb rregullim i ri ligjor dhe paralel.<\/p>\n<p>IX. Neni 21 [t\u00eb kthyerit n\u00eb Kosov\u00eb]<\/p>\n<p>Kjo \u00ebsht\u00eb kompetenc\u00eb shtet\u00ebrore q\u00eb ushtrohet nga Qeveria. Ekziston sektor i ve\u00e7ant\u00eb qeveritar p\u00ebr k\u00ebt\u00eb proces, i themeluar si organ shteti, q\u00eb \u00ebsht\u00eb Ministria p\u00ebr Komunitete dhe Kthim.<\/p>\n<p>N\u00ebse kjo mbetet n\u00eb statut t\u00eb AKS-s\u00eb, at\u00ebher\u00eb kemi dualiz\u00ebm t\u00eb kompetencave n\u00eb k\u00ebt\u00eb fush\u00eb. Pse duhet t\u00eb rregullohet kjo paralelisht?<\/p>\n<p>X. Neni 37 [Zyra e Ndihm\u00ebs Juridike]<\/p>\n<p>Kjo \u00ebsht\u00eb e rregulluar me ligjin 04\/L-017 p\u00ebr ndihm\u00eb juridike falas. N\u00eb Kosov\u00eb ekziston Agjencia p\u00ebr Ndihm\u00eb Juridike Falas, dhe ofron sh\u00ebrbime profesionale p\u00ebr t\u00eb gjith\u00eb qytetar\u00ebt\/shtetasit e Kosov\u00ebs pa asnj\u00eb dallim. \u00cbsht\u00eb nd\u00ebr institucionet q\u00eb ka funksionuar m\u00eb s\u00eb miri n\u00eb Kosov\u00eb.<\/p>\n<p>AKS-ja nuk duhet t\u00eb ket\u00eb kompetenca q\u00eb t\u00eb krijoj\u00eb nj\u00eb institucion t\u00eb till\u00eb paralel.<\/p>\n<p>Pse duhet t\u00eb b\u00ebhet rregullim paralel p\u00ebr ndihm\u00ebn juridike falas?<\/p>\n<p>XI. Neni 42 [zgjidhja e mosmarr\u00ebveshjeve nd\u00ebrmjet Asociacionit dhe autoriteteve qendrore]<\/p>\n<p>AKS dhe Autoritetet Qendrore t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs nuk kan\u00eb marr\u00ebdh\u00ebnie kontraktuale, q\u00eb t\u00eb zgjidhin n\u00eb procedur\u00eb arbitrazhi.<\/p>\n<p>\u00c7do tejkalim i kompetencave ose autorizimeve n\u00eb raport me statutin e AKS-s\u00eb duhet t\u00eb zgjidhet n\u00eb procedur\u00eb gjyq\u00ebsore n\u00eb gjykatat e rregullta ose n\u00eb Gjykat\u00ebn Kushtetuese t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, duke i respektuar procedurat ligjore si\u00e7 e p\u00ebrcakton legjislacioni n\u00eb fuqi p\u00ebr secilin subjekt juridik.<\/p>\n<p>XII.
