Duke p\u00ebrfituar nga ky vendim, Komuna e Gjilanit ka publikuar menj\u00ebher\u00eb njoftimin n\u00eb platform\u00ebn elektronike t\u00eb prokurimit publik (E-prokurimi), duke ftuar kompanit\u00eb q\u00eb t\u00eb dor\u00ebzojn\u00eb ofertat e tyre deri t\u00eb h\u00ebn\u00ebn, m\u00eb 26 maj 2025, shkruan Demorkacia.com.<\/p>\n<p>Zyra e Prokurimit e Komun\u00ebs s\u00eb Gjilanit duket se \u00ebsht\u00eb p\u00ebrgatitur t\u00eb p\u00ebrfshihet n\u00eb nj\u00eb kund\u00ebrligjsh\u00ebmri rreth k\u00ebtij tenderi prestigjioz p\u00ebr nd\u00ebrtimin e bulevardit t\u00eb qytetit, projekt ky me nj\u00eb vler\u00eb t\u00eb llogaritur prej 18 milion\u00eb eurosh. Vet\u00eb afati i ri p\u00ebr dor\u00ebzimin e ofertave p\u00ebrb\u00ebn nj\u00eb pik\u00eb kritike, pasi n\u00eb E-prokurim \u00ebsht\u00eb ngarkuar sot n\u00eb or\u00ebn 9:18 h dosja e tenderit e korrigjuar, po ashtu nj\u00eb njoftimi p\u00ebr OE \u00ebsht\u00eb ngarkuar sot n\u00eb or\u00ebn 09:18 n\u00eb sistem, duke treguar se afati p\u00ebr dor\u00ebzimin e ofertave p\u00ebrfundon t\u00eb h\u00ebn\u00ebn n\u00eb or\u00ebn 14:00. Gjithashtu, rregullorja k\u00ebrkon q\u00eb autoriteti t\u00eb p\u00ebrgatis\u00eb dhe t\u00eb publikoj\u00eb njoftimin p\u00ebr korrigjim t\u00eb procedur\u00ebs. Vlera e tij \u00ebsht\u00eb e lart\u00eb \u2013 18 milion\u00eb euro \u2013 por jo m\u00eb pak t\u00eb larta jan\u00eb edhe dyshimet p\u00ebr favorizim t\u00eb operator\u00ebve t\u00eb caktuar.<\/p>\n<p>Dy kompani t\u00eb interesuara p\u00ebr k\u00ebt\u00eb kontrat\u00eb, \u201cPro&#038;Co Group\u201d dhe \u201cSemaks\u201d Sh.p.k, kan\u00eb dor\u00ebzuar ankesa pran\u00eb OSHP-s\u00eb, duke akuzuar komun\u00ebn p\u00ebr p\u00ebrpilimin e kritereve diskriminuese dhe t\u00eb paarsyeshme. N\u00eb ve\u00e7anti, kompanit\u00eb kan\u00eb theksuar se shum\u00eb nga specifikimet teknike dhe k\u00ebrkesat p\u00ebr pajisje jan\u00eb t\u00eb sajuara q\u00ebllimisht p\u00ebr t\u00eb favorizuar kompani t\u00eb caktuara dhe p\u00ebr t\u00eb eliminuar pjes\u00ebmarr\u00ebs t\u00eb tjer\u00eb t\u00eb mundsh\u00ebm nga gara.<\/p>\n<p>Ekspertja shqyrtuese Blerina Huruglica dhe eksperti teknik Enver Byty\u00e7i kan\u00eb hartuar nj\u00eb raport t\u00eb detajuar, duke konkluduar se n\u00eb dosjen e tenderit jan\u00eb p\u00ebrfshir\u00eb kritere q\u00eb shkelin parimet themelore t\u00eb ligjit p\u00ebr prokurimin publik.<\/p>\n<p>Sipas ekspert\u00ebve, k\u00ebrkesat specifike p\u00ebr pajisjet e caktuara, si ato p\u00ebr kamion\u00eb me kran, gjysm\u00eb rimorkio kompresor, traktor\u00eb me fshesa, dhe automjete t\u00eb tjera, jan\u00eb t\u00eb paqarta dhe kufizuese, duke favorizuar operator\u00eb t\u00eb caktuar dhe duke kufizuar konkurrenc\u00ebn. P\u00ebr shum\u00eb nga k\u00ebto pajisje, ekspert\u00ebt teknik\u00eb kan\u00eb theksuar se k\u00ebrkesa p\u00ebr p\u00eblqime, ateste, regjistrime valide, ose lloj pajisjesh t\u00eb specializuara, nuk \u00ebsht\u00eb e domosdoshme p\u00ebr natyr\u00ebn e punimeve t\u00eb projektit dhe shkel ligjin e prokurimit publik. K\u00ebto k\u00ebrkesa p\u00ebrb\u00ebjn\u00eb barriera t\u00eb panevojshme p\u00ebr operator\u00ebt dhe jan\u00eb konsideruar si diskriminuese, duke favorizuar disa kompani dhe duke penguar nj\u00eb konkurrenc\u00eb t\u00eb drejt\u00eb dhe t\u00eb hapur.<\/p>\n<p>P\u00ebr m\u00eb tep\u00ebr, problemi i afateve t\u00eb tenderimit \u00ebsht\u00eb ngritur si nj\u00eb tjet\u00ebr aspekt kritik, ku \u00ebsht\u00eb argumentuar se afati p\u00ebr dor\u00ebzimin e ofertave \u00ebsht\u00eb shkurtuar n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme, duke shkelur nenet p\u00ebrkat\u00ebse t\u00eb Ligjit t\u00eb Prokurimit Publik.<\/p>\n<p>P\u00ebrfundimisht, ekspert\u00ebt kan\u00eb rekomanduar ndryshime n\u00eb dosjen e tenderit p\u00ebr t\u00eb korrigjuar k\u00ebto shkelje dhe p\u00ebr t\u00eb siguruar q\u00eb procedurat e tenderimit t\u00eb jen\u00eb n\u00eb p\u00ebrputhje t\u00eb plot\u00eb me ligjin dhe t\u00eb krijojn\u00eb mund\u00ebsi t\u00eb barabarta p\u00ebr t\u00eb gjith\u00eb operator\u00ebt ekonomik\u00eb.<\/p>\n<p>Pretendimi i dyt\u00eb i Operatorit Ekonomik ankimues:<\/p>\n<p>Eksperti teknik ka vler\u00ebsuar se certifikatat e k\u00ebrkuara jan\u00eb t\u00eb natyr\u00ebs specifike dhe kan\u00eb t\u00eb b\u00ebjn\u00eb drejtp\u00ebrdrejt me prodhuesit e shtyllave t\u00eb ndri\u00e7imit dhe t\u00eb pajisjeve elektrike. Duhet theksuar se, n\u00eb rastin e pun\u00ebve t\u00eb nd\u00ebrtimit me p\u00ebrfshirje t\u00eb elementeve elektrike, t\u00eb gjitha materialet duhet t\u00eb jen\u00eb t\u00eb certifikuara dhe n\u00eb p\u00ebrputhje me standardet dhe legjislacionin p\u00ebrkat\u00ebs n\u00eb fuqi.<\/p>\n<p>Gjithsesi, eksperti thekson se certifikatat p\u00ebr produktet nd\u00ebrtimore, si\u00e7 jan\u00eb k\u00ebto t\u00eb p\u00ebrmendura, zakonisht verifikohen gjat\u00eb faz\u00ebs s\u00eb implementimit t\u00eb projektit, dhe jo domosdoshm\u00ebrisht n\u00eb faz\u00ebn e ofertimit. P\u00ebr rrjedhoj\u00eb, vendosja e k\u00ebtyre k\u00ebrkesave n\u00eb k\u00ebt\u00eb faz\u00eb t\u00eb procedur\u00ebs s\u00eb prokurimit \u00ebsht\u00eb e pajustifikuar dhe e panevojshme, duke rezultuar n\u00eb kufizim t\u00eb panevojsh\u00ebm t\u00eb konkurrenc\u00ebs. Eksperti teknik rekomandon q\u00eb Autoriteti Kontraktues t\u00eb korrigjoj\u00eb dokumentet e tenderit dhe t\u00eb heq\u00eb k\u00ebto k\u00ebrkesa nga DT.<\/p>\n<p>Pretendimi i tret\u00eb i OE ankimues:<\/p>\n<p>Eksperti teknik ka analizuar t\u00eb gjith\u00eb list\u00ebn e pajisjeve dhe konstaton se n\u00eb dosjen e tenderit jan\u00eb k\u00ebrkuar gjithsej 35 lloje pajisjesh dhe makinerish p\u00ebr realizimin e projektit. Eksperti sqaron se \u00e7do projekt i hartuar p\u00ebr ekzekutim p\u00ebrmban metodologjin\u00eb e pun\u00ebs, ku nd\u00ebr t\u00eb tjera p\u00ebrcaktohen afatet kohore dhe resurset e projektit. N\u00eb p\u00ebrputhje me organizimin dhe teknologjin\u00eb e nd\u00ebrtimit, metodologjin\u00eb e pun\u00ebs dhe afatet kohore, p\u00ebrcaktohen edhe angazhimet e stafit t\u00eb nevojsh\u00ebm dhe t\u00eb makineris\u00eb s\u00eb domosdoshme p\u00ebr realizimin e aktiviteteve nd\u00ebrtimore dhe t\u00eb projektit n\u00eb t\u00ebr\u00ebsi. Bazuar n\u00eb k\u00ebto analiza, vler\u00ebsohen pajisjet dhe makinerit\u00eb minimale t\u00eb nevojshme p\u00ebr realizimin e projektit.<\/p>\n<p>Duke u bazuar edhe n\u00eb p\u00ebrgjigjet e Autoritetit Kontraktues (AK) n\u00eb k\u00ebrkes\u00ebn p\u00ebr rishqyrtim, nuk mund t\u00eb thuhet me siguri se ekzistojn\u00eb plane dhe dokumente t\u00eb detajuara t\u00eb projektit. Prandaj, eksperti teknik do t\u00eb vler\u00ebsoj\u00eb n\u00eb baz\u00eb t\u00eb fush\u00ebveprimit t\u00eb projektit dhe p\u00ebrshkrimit t\u00eb pajisjeve t\u00eb k\u00ebrkuara. Disa nga pajisjet jan\u00eb subjekt i pik\u00ebs ankimore nga OE, dhe n\u00eb vazhdim do t\u00eb paraqitet vler\u00ebsimi p\u00ebr secil\u00ebn prej tyre sipas numrit rendor t\u00eb pajisjes n\u00eb list\u00ebn e bashk\u00ebngjitur nga AK \u2013 Aneksi 7.<\/p>\n<p>Pajisja nr. 8<br \/>\nGjysm\u00ebrimorkio speciale me 2 pompa p\u00ebr zhbllokimin e kanalizimit dhe zbrazjen e pusetave me presion min. 200 bar, me kapacitet 5000 litra.<\/p>\n<p>OE ankues ka k\u00ebrkuar q\u00eb kjo pajisje t\u00eb largohet nga dosja e tenderit (DT), pasi q\u00eb n\u00eb asnj\u00eb pozicion t\u00eb projektit nuk p\u00ebrfshihet p\u00ebrdorimi i saj.<\/p>\n<p>P\u00ebrgjigje nga eksperti teknik:<br \/>\nEksperti vler\u00ebson se, bazuar n\u00eb p\u00ebrshkrimin e pun\u00ebve, kjo pajisje nuk gjen p\u00ebrdorim n\u00eb projektin n\u00eb fjal\u00eb dhe \u00ebsht\u00eb e panevojshme. N\u00ebse AK e ka vler\u00ebsuar t\u00eb nevojshme, duhet t\u00eb ket\u00eb edhe pozicione konkrete t\u00eb pun\u00ebve nd\u00ebrtimore q\u00eb e justifikojn\u00eb p\u00ebrdorimin e saj. N\u00eb p\u00ebrgjigjen e dh\u00ebn\u00eb, AK ka theksuar se pajisja sh\u00ebrben p\u00ebr zhbllokimin e gypave n\u00eb ky\u00e7jen e rrjetit t\u00eb ri t\u00eb kanalizimit \u2013 pozicion i cili mungon n\u00eb paramas\u00eb dhe nuk mund t\u00eb realizohet. Prandaj, AK duhet t\u00eb korrigjoj\u00eb dosjen e tenderit pasi q\u00eb pajisja \u00ebsht\u00eb e panevojshme.<br \/>\nPretendimi p\u00ebr pajisjen nr. 8 konsiderohet i bazuar.<\/p>\n<p>Pajisja nr. 16<br \/>\nVin\u00e7 hidraulik i destinuar p\u00ebr ngarkimin dhe shkarkimin e automjeteve.<\/p>\n<p>OE ka k\u00ebrkuar largimin e k\u00ebsaj pajisjeje me arsyetimin se ekzistojn\u00eb metoda t\u00eb tjera p\u00ebr ngarkim dhe shkarkim. AK ka deklaruar se pajisja \u00ebsht\u00eb menduar p\u00ebr ngarkim dhe shkarkim t\u00eb materialeve nd\u00ebrtimore dhe ka shtuar se mjafton t\u00eb jet\u00eb nj\u00eb vin\u00e7 hidraulik.<\/p>\n<p>P\u00ebrgjigje nga eksperti teknik:<br \/>\nK\u00ebrkesa p\u00ebr k\u00ebt\u00eb pajisje \u00ebsht\u00eb vler\u00ebsuar si diskriminuese, pasi q\u00eb ekzistojn\u00eb metoda t\u00eb ndryshme p\u00ebr kryerjen e k\u00ebtij funksioni. Pajisja n\u00eb fjal\u00eb \u00ebsht\u00eb e rrall\u00eb n\u00eb praktik\u00eb dhe nj\u00eb k\u00ebrkes\u00eb e till\u00eb vet\u00ebm sa kufizon konkurrenc\u00ebn, duke orientuar drejt OE-ve t\u00eb caktuara. P\u00ebrshkrimi duhet t\u00eb modifikohet dhe t\u00eb p\u00ebrshtatet me natyr\u00ebn e pun\u00ebs s\u00eb projektit, si\u00e7 \u00ebsht\u00eb p\u00ebrmendur n\u00eb p\u00ebrgjigjen e AK.<br \/>\nPretendimi p\u00ebr pajisjen nr. 16 konsiderohet i bazuar.<\/p>\n<p>Pajisja nr. 17<br \/>\nVin\u00e7 \u2013 ashensor me konstruksion metalik p\u00ebr bartjen dhe ngritjen e materialeve, elektromotorik, me lart\u00ebsi deri n\u00eb 40 m.<\/p>\n<p>OE ka k\u00ebrkuar largimin e pajisjes si t\u00eb panevojshme, duke argumentuar se nuk ka objekte q\u00eb k\u00ebrkojn\u00eb nj\u00eb lart\u00ebsi t\u00eb till\u00eb n\u00eb projekt.<\/p>\n<p>P\u00ebrgjigje nga eksperti teknik:<br \/>\nP\u00ebrshkrimi p\u00ebr pajisjen nr. 17 \u00ebsht\u00eb kufizues, dhe lart\u00ebsia deri n\u00eb 40 metra e p\u00ebrkufizon si nj\u00eb pajisje shum\u00eb specifike. P\u00ebr shkak se jan\u00eb pajisje t\u00eb rralla, k\u00ebrkesa kufizon konkurrenc\u00ebn. Ka pajisje t\u00eb ndryshme q\u00eb kryejn\u00eb t\u00eb nj\u00ebjtin funksion \u2013 si\u00e7 jan\u00eb vin\u00e7-kullat \u2013 prandaj k\u00ebrkesa duhet t\u00eb modifikohet dhe t\u00eb lejoj\u00eb p\u00ebrdorimin e pajisjeve alternative. P\u00ebr m\u00eb tep\u00ebr, edhe pse objekti i administrat\u00ebs ka nj\u00eb lart\u00ebsi t\u00eb caktuar, kufizimi deri n\u00eb 40 m duhet t\u00eb shihet si prag maksimal, duke lejuar edhe lart\u00ebsi m\u00eb t\u00eb ul\u00ebta.<br \/>\nPretendimi p\u00ebr pajisjen nr. 17 konsiderohet pjes\u00ebrisht i bazuar.<\/p>\n<p>Pajisja nr. 18<br \/>\nInstrument p\u00ebr certifikim dhe testim t\u00eb kabllove \u2013 Multimates TESTPRO CV100-K50 Copper Certification Kit.<\/p>\n<p>OE ka k\u00ebrkuar largimin e pajisjes si t\u00eb panevojshme, duke argumentuar se k\u00ebto jan\u00eb pajisje q\u00eb zot\u00ebrohen nga kompani t\u00eb specializuara, nd\u00ebrsa OE-t\u00eb nd\u00ebrtimore zakonisht nuk i posedojn\u00eb.<\/p>\n<p>P\u00ebrgjigje nga eksperti teknik:<br \/>\nN\u00eb kuad\u00ebr t\u00eb projektit ka punime elektrike, dhe gjat\u00eb realizimit mund t\u00eb k\u00ebrkohet testim i kabllove p\u00ebr t\u00eb siguruar performanc\u00eb dhe cil\u00ebsi.
