Edhe n\u00eb rastet m\u00eb ekstreme t\u00eb luft\u00ebs, pengmarrjes, ka rregulla kur mbahet dikush e shtr\u00ebnguar fizikisht, nd\u00ebrsa n\u00eb rastin n\u00eb Gjilan, tinejxheret nuk respektojn\u00eb asnj\u00eb kod t\u00eb pashkruar e t\u00eb shkruar njer\u00ebzor. Termi \u201ctortur\u00eb\u201d sipas Konvent\u00ebs kund\u00ebr Tortur\u00ebs dhe Trajtimeve ose Nd\u00ebshkimeve t\u00eb Tjera Mizore, \u00c7njer\u00ebzore ose Posht\u00ebruese, \u201cn\u00ebnkupton \u00e7do akt me an\u00eb t\u00eb t\u00eb cilit nj\u00eb personi i shkaktohet q\u00ebllimisht dhimbje ose vuajtje e fort\u00eb, qoft\u00eb fizike ose mendore, p\u00ebr q\u00ebllime t\u00eb tilla si marrja prej tij ose nj\u00eb personi t\u00eb tret\u00eb informacioni ose nj\u00eb rr\u00ebfimi, nd\u00ebshkimi i tij p\u00ebr nj\u00eb veprim q\u00eb ai ose nj\u00eb person i tret\u00eb ka kryer ose dyshohet se e ka kryer, ose frik\u00ebsimi ose shtr\u00ebngimi i tij ose i nj\u00eb personi t\u00eb tret\u00eb, ose p\u00ebr \u00e7do arsye t\u00eb bazuar n\u00eb diskriminim t\u00eb \u00e7do lloji, kur nj\u00eb dhimbje ose vuajtje e till\u00eb shkaktohet nga ose me nxitjen e ose me p\u00eblqimin ose pranimin e nj\u00eb zyrtari publik ose nj\u00eb personi tjet\u00ebr q\u00eb vepron n\u00eb nj\u00eb cil\u00ebsi zyrtare.\u201d (Konventa kund\u00ebr Tortur\u00ebs dhe Trajtimeve ose Nd\u00ebshkimeve t\u00eb Tjera Mizore, \u00c7njer\u00ebzore ose Posht\u00ebruese, neni 1, 1987, n\u00eb linkun: https:\/\/www.ohchr.org\/sites\/default\/files\/cat.pdf)<\/p>\n<p>P\u00ebr shkak se tortura nuk \u00ebsht\u00eb kryer nga zyrtar\u00eb ose n\u00eb cil\u00ebsin\u00eb zyrtare, Konventa merret me obligimet e shteteve, q\u00eb duhet t\u00eb parandalojn\u00eb \u00e7far\u00ebdo torture, madje te neni 16 i Konvent\u00ebs, shteti merr p\u00ebrgjegj\u00ebsi p\u00ebr parandalimin e \u00e7far\u00ebdo torture q\u00eb ndodh nga civil\u00ebt dhe merr obligime p\u00ebr t\u00eb zbatuar drejt\u00ebsin\u00eb me nd\u00ebshkime sa her\u00eb t\u00eb shfaqet tortura si akt \u00e7njer\u00ebzor. Sidoqoft\u00eb, ajo q\u00eb e shohim n\u00eb video nuk \u00ebsht\u00eb bulliz\u00ebm, sepse ngacmim n\u00ebnkupton \u00e7do shqet\u00ebsim, bezdisje, me fjal\u00eb, gjeste, veprime dhe mund t\u00eb jet\u00eb nga m\u00eb i lehti deri te m\u00eb i r\u00ebndi, nd\u00ebrsa tortura \u00ebsht\u00eb gjithmon\u00eb e r\u00ebnd\u00eb, \u00e7njer\u00ebzore, posht\u00ebruese, mizore. Prandaj, pavar\u00ebsisht shkall\u00ebs m\u00eb t\u00eb ul\u00ebt t\u00eb p\u00ebrgjegj\u00ebsis\u00eb si t\u00eb mitura me \u00e7do ligj n\u00eb bot\u00eb, norm\u00eb shoq\u00ebrore e kulturore, t\u00eb miturat n\u00eb q\u00ebllim, p\u00ebrmbajtje e sjellje, kan\u00eb kryer tortur\u00eb, megjith\u00ebse nuk hyn n\u00eb ndonj\u00eb kategori juridike t\u00eb konventave nd\u00ebrkomb\u00ebtare, q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb n\u00eb radh\u00eb t\u00eb par\u00eb me shtetet dhe zyrtar\u00ebt. Prandaj, p\u00ebr ta dalluar tortur\u00ebn sipas Konvent\u00ebs, nga ajo q\u00eb kan\u00eb b\u00ebr\u00eb vajzat, do ta quaja \u201ctortur\u00eb private\u201d, ose \u201ctortur\u00eb civile\u201d, dhe p\u00ebrderisa ka ndodhur n\u00eb grup t\u00eb miturash, at\u00ebher\u00eb edhe \u201ctortur\u00eb civile grupore\u201d, ose \u201ctortur\u00eb civile n\u00eb grup\u201d. P\u00ebr shkak se t\u00eb miturat q\u00eb kan\u00eb kryer tortur\u00ebn ndaj bashk\u00ebmoshatares s\u00eb tyre, e kan\u00eb xhiruar me video dhe video ka qarkulluar jo vet\u00ebm te viktima e prind\u00ebrit e saj, por n\u00eb t\u00eb gjith\u00eb hap\u00ebsir\u00ebn publike, ajo mund t\u00eb quhet edhe \u201ctortur\u00eb publike\u201d, \u00e7ka e b\u00ebn ngjarjen edhe m\u00eb mizore. Sidoqoft\u00eb, \u00ebsht\u00eb dhun\u00eb mizore, krejt e ngjashme me tortur\u00ebn, por juridikisht nuk njihet si tortur\u00eb, dhe nuk ka t\u00eb b\u00ebj\u00eb me konceptin e tortur\u00ebs nga Konventa. Tortura civile nga ajo shtet\u00ebrore ose zyrtare, dallon edhe nga pushteti. Tortura nga organet e shtetit vjen nga t\u00eb pushtetshmit, nd\u00ebrsa ajo civile jo me at\u00eb pushtet, ndon\u00ebse jo pa fuqi fizike p\u00ebr kontroll t\u00eb viktim\u00ebs dhe organizim n\u00eb grup. Madje, nga rr\u00ebfimi p\u00ebr ngjarjen, ka analogji edhe me rr\u00ebmbim e kidnapim, se si e kan\u00eb sjell\u00eb n\u00eb sht\u00ebpin\u00eb e braktisur, vet\u00eb viktim\u00ebn, p\u00ebrmes shoqes s\u00eb saj. Viktima p\u00ebrjeton jo vet\u00ebm l\u00ebndime fizike, trupore, por edhe traumatizohet, posht\u00ebrohet n\u00eb grup e publikisht dhe shtr\u00ebngohet \u00e7njer\u00ebzisht. Ajo p\u00ebson d\u00ebme afatgjata, traum\u00eb, humbje totale t\u00eb besimit tek t\u00eb tjer\u00ebt, r\u00ebnie drastike t\u00eb vet\u00ebbesimit, vet\u00ebvler\u00ebsimit, vet\u00ebrespektit; ankth, depresion, izolim, vetmi, pasoja p\u00ebr sh\u00ebndetin fizik, v\u00ebshtir\u00ebsi p\u00ebr marr\u00ebdh\u00ebnie sociale me t\u00eb tjer\u00ebt, efekte n\u00eb suksesin n\u00eb shkoll\u00eb dhe arritjet akademike, rreziqe t\u00eb panum\u00ebrta etj. Prandaj, krejt v\u00ebmendja duhet t\u00eb jet\u00eb te viktima, n\u00eb radh\u00eb t\u00eb par\u00eb. Duhet angazhim i shkoll\u00ebs, drejtoris\u00eb, m\u00ebsimdh\u00ebn\u00ebsve, bashk\u00ebmoshatar\u00ebve p\u00ebr ta p\u00ebrkrahur pas tragjedis\u00eb. Familja e viktim\u00ebs si pal\u00eb e d\u00ebmtuar, duhet t\u00eb kompensohet edhe materialisht sipas ligjeve n\u00eb fuqi. Prind\u00ebrit, p\u00ebr shkak t\u00eb kujdesit intensiv dhe sistematik q\u00eb duhen ta ken\u00eb p\u00ebr f\u00ebmij\u00ebn viktim\u00eb, n\u00ebse jan\u00eb t\u00eb angazhuar n\u00eb sektorin publik, t\u00eb ken\u00eb pushim deri n\u00eb nj\u00eb periudh\u00eb t\u00eb arsyeshme, me pages\u00eb t\u00eb plot\u00eb. N\u00ebse jan\u00eb n\u00eb sektorin privat, apo t\u00eb vet\u00ebpun\u00ebsuar, duhet gjithashtu t\u00eb ket\u00eb mb\u00ebshtetje nga vet\u00eb pun\u00ebdh\u00ebn\u00ebsi privat dhe komuna e shteti. F\u00ebmija ka m\u00eb shum\u00eb se kurdoher\u00eb, nevoj\u00eb p\u00ebr prani fizike e psikologjike t\u00eb prind\u00ebrve. F\u00ebmija duhet t\u00eb p\u00ebrfshihet n\u00eb aktivitete kulturore, sportive, var\u00ebsisht nga talenti e hobi i saj, ecje n\u00eb natyr\u00eb, p\u00ebr t\u2019u integruar n\u00eb shoq\u00ebri. E mbijetuara e dhun\u00ebs grupore t\u00eb tinejxhereve, duhet t\u00eb p\u00ebrkrahet m\u00eb s\u00eb shumti, nga t\u00eb gjith\u00eb dhe sistematikisht. M\u00eb s\u00eb shumti institucionalisht, e shoq\u00ebrisht.<\/p>\n<p>Dhuna e tinejxhereve<\/p>\n<p>N\u00eb krejt bot\u00ebn, tinejxher\u00ebt, p\u00ebr shkak se ende nuk i kan\u00eb p\u00ebrmbushur as 18 vje\u00e7, trajtohen n\u00eb m\u00ebnyr\u00eb t\u00eb ve\u00e7ant\u00eb, nga shteti, drejt\u00ebsia dhe \u00e7do institucion tjet\u00ebr. Presupozohet q\u00eb tinejxher\u00ebt, ve\u00e7mas 13-14 vje\u00e7aret, duke u ballafaquar me nj\u00eb ndryshim t\u00eb theksuar fizik, fiziologjik, hormonal, social e psikologjik, ato meritojn\u00eb kujdes specifik ve\u00e7mas n\u00eb k\u00ebt\u00eb mosh\u00eb puberteti. Fillojn\u00eb ta njohin identitetin personal e me mund\u00ebsi edhe t\u00eb krizave t\u00eb identitetit, merakosen me tepri p\u00ebr dukjen fizike, lidhen m\u00eb shum\u00eb me shoqet, bashk\u00ebmoshatar\u00ebt, duke u ndikuar tejmase prej tyre. Jan\u00eb m\u00eb labile emocionalisht, sa jan\u00eb n\u00eb g\u00ebzim, mund t\u00eb kalojn\u00eb n\u00eb d\u00ebshp\u00ebrim. Krijojn\u00eb ndjenja t\u00eb forta p\u00ebr identitetin social e grupor. Kan\u00eb shum\u00eb sfida se si i kontrollojn\u00eb dhe menaxhojn\u00eb pritshm\u00ebrit\u00eb p\u00ebr veten e tyre n\u00eb m\u00ebsime, p\u00ebr v\u00ebmendje sociale, zem\u00ebrimin etj. Kan\u00eb shum\u00eb v\u00ebshtir\u00ebsi q\u00eb t\u2019i ndajn\u00eb mendimet, shqet\u00ebsimet e tyre me t\u00eb tjer\u00ebt, sepse gjithmon\u00eb e kan\u00eb nj\u00eb bindje \u201cnuk na kupton neve askush\u201d. Kryesisht ndajn\u00eb privat\u00ebsi me shoqet, e m\u00eb pak me familjen, n\u00ebse nuk rriten me komunikim m\u00eb demokratik brenda sht\u00ebpis\u00eb. Pra, as p\u00ebr k\u00ebto t\u00eb miturat e tjera, nuk ka d\u00ebnim, por edukim, rehabilitim dhe risocializim. Kriteret diagnostifikuese jan\u00eb:<br \/>\n\u201cA. Nj\u00eb model i p\u00ebrhapur i shp\u00ebrfilljes dhe shkeljes s\u00eb t\u00eb drejtave t\u00eb t\u00eb tjer\u00ebve, q\u00eb ndodh q\u00eb nga mosha 15 vje\u00e7, si\u00e7 tregohet nga tre (ose m\u00eb shum\u00eb) nga t\u00eb m\u00ebposhtmet:<\/p>\n<p>1. Sipas DSM-s\u00eb 5-TR, thuhet: \u201cTipari thelb\u00ebsor i \u00e7rregullimit t\u00eb personalitetit antisocial \u00ebsht\u00eb nj\u00eb model i p\u00ebrhapur i shp\u00ebrfilljes dhe shkeljes s\u00eb t\u00eb drejtave t\u00eb t\u00eb tjer\u00ebve q\u00eb fillon n\u00eb f\u00ebmij\u00ebri ose adoleshenc\u00ebn e hershme dhe vazhdon n\u00eb mosh\u00eb madhore. Ky model \u00ebsht\u00eb referuar edhe si psikopati, sociopati ose \u00e7rregullim i personalitetit dissocial. Meqen\u00ebse mashtrimi dhe manipulimi jan\u00eb tipare qendrore t\u00eb \u00e7rregullimit t\u00eb personalitetit antisocial, mund t\u00eb jet\u00eb ve\u00e7an\u00ebrisht e dobishme t\u00eb integrohet informacioni i fituar nga vler\u00ebsimi klinik sistematik me informacionin e mbledhur nga burime an\u00ebsore.\u201d(Po aty, f.749)<\/p>\n<p>Por a mund t\u00eb jet\u00eb i diagnostifikuar nj\u00eb invidid me F.60.2, n\u00ebse \u00ebsht\u00eb n\u00ebn 18 vje\u00e7? Jo, n\u00eb asnj\u00eb m\u00ebnyr\u00eb. \u201cQ\u00eb t\u00eb jepet kjo diagnoz\u00eb, individi duhet t\u00eb jet\u00eb t\u00eb pakt\u00ebn 18 vje\u00e7 (Kriteri B) dhe duhet t\u00eb ket\u00eb pasur prova t\u00eb \u00e7rregullimit t\u00eb sjelljes me fillim para mosh\u00ebs 15 vje\u00e7 (Kriteri C). \u00c7rregullimi i sjelljes p\u00ebrfshin nj\u00eb model sjelljeje p\u00ebrs\u00ebrit\u00ebse dhe t\u00eb vazhdueshme n\u00eb t\u00eb cil\u00ebn shkelen t\u00eb drejtat themelore t\u00eb t\u00eb tjer\u00ebve ose normat ose rregullat kryesore shoq\u00ebrore t\u00eb p\u00ebrshtatshme p\u00ebr mosh\u00ebn. K\u00ebta individ\u00eb gjithashtu shfaqin nj\u00eb shp\u00ebrfillje t\u00eb pamatur p\u00ebr sigurin\u00eb e tyre ose t\u00eb t\u00eb tjer\u00ebve (Kriteri A5). <\/p>\n<p>Kjo mund t\u00eb d\u00ebshmohet n\u00eb sjelljen e tyre t\u00eb ngasjes (p.sh., shpejt\u00ebsi e p\u00ebrs\u00ebritur, drejtim n\u00ebn ndikimin e alkoolit, aksidente t\u00eb shum\u00ebfishta). Ata mund t\u00eb p\u00ebrfshihen n\u00eb sjellje seksuale ose p\u00ebrdorim substancash q\u00eb kan\u00eb nj\u00eb rrezik t\u00eb lart\u00eb me pasoja t\u00eb d\u00ebmshme. Individ\u00ebt me \u00e7rregullim t\u00eb personalitetit antisocial gjithashtu kan\u00eb tendenc\u00eb t\u00eb jen\u00eb vazhdimisht dhe jasht\u00ebzakonisht t\u00eb pap\u00ebrgjegjsh\u00ebm (Kriteri A6). Sjellja e pap\u00ebrgjegjshme n\u00eb pun\u00eb mund t\u00eb tregohet nga periudha t\u00eb konsiderueshme papun\u00ebsie pavar\u00ebsisht mund\u00ebsive t\u00eb pun\u00ebs n\u00eb dispozicion, ose nga braktisja e disa vendeve t\u00eb pun\u00ebs pa nj\u00eb plan realist p\u00ebr t\u00eb gjetur nj\u00eb pun\u00eb tjet\u00ebr. Mund t\u00eb ket\u00eb gjithashtu nj\u00eb model t\u00eb mungesave t\u00eb p\u00ebrs\u00ebritura nga puna q\u00eb nuk shpjegohen nga s\u00ebmundja as tek ata vet\u00eb as n\u00eb familjen e tyre. Pap\u00ebrgjegj\u00ebsia financiare tregohet nga veprime t\u00eb tilla si mospagimi i borxheve, mosdh\u00ebnia e mb\u00ebshtetjes p\u00ebr f\u00ebmij\u00ebt ose mosmb\u00ebshtetja e personave t\u00eb tjer\u00eb n\u00eb var\u00ebsi n\u00eb m\u00ebnyr\u00eb t\u00eb rregullt. Individ\u00ebt me \u00e7rregullim t\u00eb personalitetit antisocial tregojn\u00eb pak keqardhje p\u00ebr pasojat e veprimeve t\u00eb tyre (Kriteri A7). Ata mund t\u00eb jen\u00eb indiferent\u00eb ose t\u00eb ofrojn\u00eb nj\u00eb justifikim sip\u00ebrfaq\u00ebsor p\u00ebr l\u00ebndimin, keqtrajtimin ose vjedhjen e dikujt (p.sh., &#8220;jeta \u00ebsht\u00eb e padrejt\u00eb&#8221;, &#8220;humb\u00ebsit meritojn\u00eb t\u00eb humbasin&#8221;). K\u00ebta individ\u00eb mund t&#8217;i faj\u00ebsojn\u00eb viktimat se jan\u00eb budallenj, t\u00eb pafuqish\u00ebm ose se e meritojn\u00eb fatin e tyre&#8230;; ata mund t\u00eb minimizojn\u00eb pasojat e d\u00ebmshme t\u00eb veprimeve t\u00eb tyre; ose thjesht mund t\u00eb tregojn\u00eb indiferenc\u00eb t\u00eb plot\u00eb. Edhe pse kjo zbehje \u00ebsht\u00eb ve\u00e7an\u00ebrisht e dukshme n\u00eb lidhje me p\u00ebrfshirjen n\u00eb sjellje kriminale, ka t\u00eb ngjar\u00eb t\u00eb ket\u00eb nj\u00eb r\u00ebnie n\u00eb t\u00eb gjith\u00eb spektrin e sjelljeve antisociale dhe n\u00eb p\u00ebrdorimin e substancave.
