I realizuar me nj\u00eb theks t\u00eb q\u00ebllimsh\u00ebm mbi pavar\u00ebsin\u00eb \u2013 pa input nga institucioni k\u00ebrkues \u2014 shqyrtimi p\u00ebrdor nj\u00eb metodologji doktrinare dhe t\u00eb bazuar n\u00eb analiz\u00eb dokumentare, t\u00eb mb\u00ebshtetur n\u00eb burime primare juridike, jurisprudenc\u00eb dhe angazhim t\u00eb informuar me praktikues t\u00eb fush\u00ebs.<\/p>\n<p>Ndon\u00ebse paraqitet shprehimisht si nj\u00eb ushtrim \u201cparaprak\u201d, raporti identifikon nj\u00eb s\u00ebr\u00eb temash themelore q\u00eb jan\u00eb qendrore p\u00ebr legjitimitetin e drejt\u00ebsis\u00eb penale nd\u00ebrkomb\u00ebtare bashk\u00ebkohore, p\u00ebrfshir\u00eb t\u00eb drejtat e t\u00eb akuzuarve, pavar\u00ebsin\u00eb gjyq\u00ebsore, drejt\u00ebsin\u00eb provuese dhe barazin\u00eb e arm\u00ebve. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, ai e vendos DhSK-n\u00eb si brenda rendit kushtetues t\u00eb Kosov\u00ebs, ashtu edhe brenda korniz\u00ebs m\u00eb t\u00eb gjer\u00eb nd\u00ebrkomb\u00ebtare t\u00eb t\u00eb drejtave t\u00eb njeriut, ve\u00e7an\u00ebrisht Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut dhe Paktit Nd\u00ebrkomb\u00ebtar p\u00ebr t\u00eb Drejtat Civile dhe Politike, t\u00eb cilat jan\u00eb t\u00eb inkorporuara drejtp\u00ebrdrejt n\u00eb legjislacionin e Kosov\u00ebs.<\/p>\n<p>Raporti gjithashtu e kontekstualizon themelimin e DhSK-s\u00eb brenda trash\u00ebgimis\u00eb politike dhe historike t\u00eb kontestuar t\u00eb konfliktit t\u00eb Kosov\u00ebs t\u00eb viteve 1998\u20131999 dhe pretendimeve t\u00eb m\u00ebvonshme p\u00ebr krime t\u00eb kryera nga an\u00ebtar\u00eb t\u00eb Ushtris\u00eb \u00c7lirimtare t\u00eb Kosov\u00ebs.<\/p>\n<p>Ai thekson natyr\u00ebn sui generis t\u00eb gjykat\u00ebs: formalisht nj\u00eb institucion vendor i krijuar sipas ligjit t\u00eb Kosov\u00ebs, por i p\u00ebrb\u00ebr\u00eb nga gjyqtar\u00eb nd\u00ebrkomb\u00ebtar\u00eb, i financuar dhe i ndikuar nga aktor\u00eb nd\u00ebrkomb\u00ebtar\u00eb, dhe me seli n\u00eb Hag\u00eb. Ky dizajn hibrid dhe, n\u00eb disa aspekte, kontradiktor nga brenda, krijon sfida t\u00eb ve\u00e7anta, sidomos n\u00eb lidhje me legjitimitetin, llogaridh\u00ebnien dhe raportin nd\u00ebrmjet standardeve nd\u00ebrkomb\u00ebtare dhe traditave juridike vendore.<\/p>\n<p>BHRC thekson se fokusi i ngusht\u00eb i DhSK-s\u00eb ndaj ish-udh\u00ebheq\u00ebsve t\u00eb U\u00c7K-s\u00eb, p\u00ebrb\u00ebrja ekskluzivisht nd\u00ebrkomb\u00ebtare e trupit gjykues dhe mb\u00ebshtetja n\u00eb mekanizma t\u00eb jasht\u00ebm financimi dhe em\u00ebrimi jan\u00eb b\u00ebr\u00eb burime t\u00eb vazhdueshme polemikash, duke ngritur pyetje si p\u00ebr perceptimin, ashtu edhe p\u00ebr realitetin e pavar\u00ebsis\u00eb dhe paanshm\u00ebris\u00eb.<\/p>\n<p>N\u00eb k\u00ebt\u00eb sfond, raporti paraqet nj\u00eb grup t\u00eb strukturuar v\u00ebzhgimesh paraprake mbi aspektet ky\u00e7e t\u00eb korniz\u00ebs juridike dhe praktik\u00ebs s\u00eb DhSK-s\u00eb, p\u00ebrfshir\u00eb lirimin e p\u00ebrkohsh\u00ebm, pavar\u00ebsin\u00eb gjyq\u00ebsore, pranueshm\u00ebrin\u00eb e provave dhe barazin\u00eb e arm\u00ebve.<\/p>\n<p>Ai konstaton se, ndon\u00ebse korniza formale juridike e gjykat\u00ebs \u00ebsht\u00eb p\u00ebrgjith\u00ebsisht solide dhe n\u00eb shum\u00eb aspekte n\u00eb p\u00ebrputhje me normat nd\u00ebrkomb\u00ebtare t\u00eb t\u00eb drejtave t\u00eb njeriut, shqet\u00ebsime t\u00eb r\u00ebnd\u00ebsishme lindin n\u00eb funksionimin e saj praktik. K\u00ebto p\u00ebrfshijn\u00eb pengesa strukturore p\u00ebr lirimin e p\u00ebrkohsh\u00ebm, mang\u00ebsi n\u00eb mekanizmat p\u00ebr kund\u00ebrshtimin e em\u00ebrimeve gjyq\u00ebsore dhe vendimeve administrative, tensione t\u00eb krijuara nga praktikat provuese (ve\u00e7an\u00ebrisht lidhur me materiale t\u00eb patestuara ose t\u00eb siguruara nga burime t\u00eb jashtme), si dhe pabarazi burimore dhe procedurale q\u00eb ndikojn\u00eb mbrojtjen.<\/p>\n<p>Raporti nuk pretendon t\u00eb arrij\u00eb p\u00ebrfundime p\u00ebrfundimtare, por identifikon fusha me rrezik potencial dhe rekomandon shqyrtim t\u00eb m\u00ebtejsh\u00ebm, duke theksuar se legjitimiteti afatgjat\u00eb i DhSK-s\u00eb do t\u00eb varet jo vet\u00ebm nga respektimi formal i standardeve juridike, por edhe nga aft\u00ebsia e saj p\u00ebr t\u2019i realizuar vazhdimisht ato standarde n\u00eb praktik\u00eb.<\/p>\n<p>N\u00eb drit\u00ebn e k\u00ebtyre gjetjeve, raporti paraqet nj\u00eb s\u00ebr\u00eb rekomandimesh t\u00eb synuara p\u00ebr forcimin e drejt\u00ebsis\u00eb, transparenc\u00ebs dhe legjitimitetit institucional t\u00eb DhSK-s\u00eb.
